1. No Refund Policy
ALL SUBSCRIPTION FEES PAID TO ASTRO AI MARKETING LLC ARE STRICTLY NON-REFUNDABLE.
Once a billing period has commenced and access to the AstroAI Platform has been granted, no refund will be issued under any circumstances, including but not limited to:
- Partial use or non-use of the Platform during a billing period
- Dissatisfaction with the Platform, its features, or AI-generated outputs
- Cancellation of your subscription during an active billing period
- Change in your business circumstances, needs, or revenue
- Failure to cancel before the next billing date
- Forgetting to use the Platform or forgetting to cancel
- Dissatisfaction with AI-generated marketing plan results
- Claims that results did not meet expectations
By subscribing to any paid plan, you acknowledge that you have read and understood this No Refund Policy and agree to its terms.
2. Usage Constitutes Acceptance of Service Delivery
The AstroAI Platform delivers its service the moment you gain access to your agency dashboard. Access to the Platform โ including the agency dashboard, client management tools, AI plan generation, client portals, file storage, and all other features โ constitutes delivery of the subscribed service.
Once an agency account is created and access is granted, the service has been delivered regardless of whether you actively use every feature during the billing period. By logging in for the first time and receiving access to your dashboard, you confirm receipt of the service for that billing period.
Any action taken on the Platform โ including but not limited to those listed in Section 3 below โ constitutes explicit confirmation that you have received, accessed, and used the service.
3. What Counts as "Usage"
The following actions each individually constitute use of the Platform and confirmation of service delivery for the applicable billing period:
- Logging into your agency dashboard
- Viewing your agency dashboard, client list, or any dashboard section
- Generating an AI marketing plan for any client
- Adding, editing, or viewing any client record
- Sharing or accessing a client onboarding form link
- A client submitting your onboarding form
- Accessing or viewing the client portal for any client
- Uploading, downloading, or viewing any file or document
- Sending any email or notification through the Platform
- Accessing settings, billing, branding, or any configuration section
- Generating an embed code or accessing the lead pool
- Any other interaction with any feature of the Platform
These usage events are automatically logged with timestamps and IP addresses in our systems and constitute binding evidence of service delivery.
4. Cancellation Policy
You may cancel your subscription at any time. To cancel:
- Log into your agency dashboard at agency.astroaibots.com
- Navigate to Settings โ Billing
- Select "Cancel Subscription" and follow the prompts
Alternatively, you may request cancellation by emailing info@astroaibots.com from the email address associated with your account. Please include your agency name and account email. We will process your cancellation request within 2 business days.
Important: Cancellation stops all future recurring charges immediately. However, cancellation does not entitle you to a refund for the current billing period already paid. Your Platform access will remain active through the end of the current billing period, after which it will be deactivated.
You are responsible for cancelling your subscription before the next billing date if you do not wish to be charged for the upcoming period. We do not issue refunds for charges that occur because you failed to cancel in time.
5. Limited Exceptions
We may, entirely at our sole and absolute discretion, issue a refund or service credit in the following very limited circumstance:
- Documented Total Service Outage: If the AstroAI Platform was completely inaccessible to you โ meaning you were unable to log in or access any feature โ for more than 72 consecutive hours due to a technical failure on our end, you may request a prorated service credit for the affected period. This exception does not apply to partial degradation of features, scheduled maintenance, internet connectivity issues on your end, or outages affecting specific features only.
To request consideration under this exception, you must contact us at info@astroaibots.com within 7 days of the outage with documentation of the issue (dates, times, and description of what was inaccessible). We will review the request and respond within 10 business days.
Approval of any refund or credit request under this section is entirely at our discretion and does not set a precedent for future requests. This exception does not apply in any other circumstances.
6. Chargeback Notice
Filing a chargeback or payment dispute with your bank, credit card issuer, or payment processor instead of contacting us directly is a violation of these Terms of Service.
If you file a chargeback, the following will occur:
- Your account will be immediately and permanently suspended pending investigation
- We will submit complete evidence to your bank and to Stripe including: your account registration IP address and timestamp, your signed agreement to these Terms, your login history, your usage logs, all client activity performed under your account, and all payment authorization records
- If the chargeback is found in our favor (which we expect given the evidence), your account will remain permanently terminated and the disputed amount will remain charged
- If the chargeback results in a forced reversal despite our evidence, the full disputed amount plus any chargeback fees charged to us by Stripe will remain legally owed by you to Astro AI Marketing LLC and may be referred to collections
- We reserve the right to pursue the full amount owed through civil legal proceedings in Comal County, Texas
We strongly encourage you to contact us directly at info@astroaibots.com before filing any dispute. In many cases, we can resolve your concern faster than the bank dispute process, which can take 60โ120 days.
7. How to Get Support Instead of Filing a Chargeback
If you have a billing concern, a problem with the Platform, or a question about a charge, please contact us directly before contacting your bank. We are responsive and will work with you to resolve issues promptly.
When contacting support, please include your agency name, the email address on your account, and a clear description of your concern. The more detail you provide, the faster we can help.
8. Evidence & Record Retention
For every account registered on the AstroAI Platform, we permanently record and retain the following information for a minimum of 7 years:
- The public IP address from which the account was registered
- The exact date and time (UTC) of account registration
- The email address provided at registration and all confirmation emails sent to that address
- All login session timestamps and IP addresses
- All Platform usage events (plans generated, clients added, files uploaded, features accessed)
- All billing events including subscription start dates, charge amounts, and charge timestamps
- The specific Terms of Service, Privacy Policy, and Refund Policy versions agreed to at registration
This evidence will be submitted in its entirety to Stripe and to your financial institution in response to any payment dispute or chargeback. This evidence has proven effective in resolving disputes in our favor and constitutes a complete record of service delivery and your agreement to our terms.
10. Lead Pool Purchases โ No Refund Policy
Lead purchases are explicitly and unconditionally non-refundable. By completing a lead purchase you agree that the service has been fully delivered and no refund will be issued.
The following terms apply specifically to individual lead purchases from the AstroAI Lead Pool:
- Variable per-lead pricing. Each lead has its own price. The exact price for every lead is displayed before purchase and must be explicitly agreed to before any charge is processed.
- Price agreement process. Before any lead purchase charge is made, you: (1) view the lead price, (2) scroll through the complete Lead Purchase Terms, (3) check a confirmation box agreeing to pay the specific stated amount, and (4) click "Purchase & Reveal." Each of these steps is logged with timestamp, IP address, and user agent as irrefutable evidence of your informed consent.
- Service delivery upon reveal. The purchased service is fully and completely delivered at the exact moment the lead contact information is revealed to you. This constitutes delivery, regardless of any subsequent outcome.
- No refund for lead quality. No refunds are issued for lead quality, contact information accuracy, appointment attendance or no-shows, prospect responsiveness, conversion rate, or any other outcome-based concern. Leads are provided as-is.
- No refund for change of mind. No refunds are issued because you changed your mind, found the lead was already contacted by you, or for any other reason once delivery has occurred.
- Technical error exception. The only exception to this no-refund policy is if a payment was successfully charged but the lead contact information was NOT revealed due to a verified technical error on our end. In this case, you may request a refund within 48 hours by emailing info@astroaibots.com with your Stripe payment intent ID. This exception does not apply if the lead was revealed and you are dissatisfied with the outcome.
- Evidence retained. For every lead purchase we retain: purchase timestamp, acceptance IP address, terms acceptance timestamp, exact price agreed to, lead reveal timestamp, and Stripe payment intent ID. This evidence is submitted in full in response to any chargeback.
- Chargeback consequences. Filing a chargeback for a lead purchase without first contacting info@astroaibots.com is a violation of these Terms and our Lead Pool Marketplace Terms, and will result in immediate account termination and referral to collections.
9. Governing Law
This Refund Policy is governed by the laws of the State of Texas. Any disputes arising under this Policy shall be resolved exclusively in the courts of Comal County, New Braunfels, Texas. You consent to personal jurisdiction in such courts.
This Refund Policy is incorporated by reference into our Terms of Service and forms part of the binding agreement between you and Astro AI Marketing LLC.
